Investigação de seis meses do Ministério Público aponta cobrança ilegal para a aprovação ambiental de obras na cidade

A facilitação para a aprovação de licenciamentos ambientais em troca de dinheiro, em Palhoça, na Grande Florianópolis, levou oito pessoas à prisão ontem. Empresários e o gerente da Fundação Cambirela do Meio Ambiente de Palhoça são suspeitos de corrupção para a construção de condomínios residenciais na cidade.

Eles foram alvos de investigação da força-tarefa do Ministério Público Estadual de Santa Catarina (MP), sediada em Florianópolis.

A ação surgiu depois que a promotoria de Justiça de Palhoça recebeu denúncias de que funcionários do órgão municipal do meio ambiente da cidade estariam exigindo valores em dinheiro para aprovar licenciamentos ambientais de obras.

Na manhã de ontem, depois de investigar os suspeitos por seis meses, foi desencadeada a Operação Cambirela. A Justiça de Palhoça decretou nove mandados de prisões preventivas e 20 mandados de busca e apreensão. Oito pessoas foram presas. Uma delas não foi localizada. As prisões foram em Palhoça, São José, Florianópolis, Balneário Camboriú e Curitiba.

Foram feitas buscas na Fundação Cambirela do Meio Ambiente de Palhoça. O gerente de Licenciamento do órgão municipal, engenheiro James Jones Silvestre, é um dos presos.

Segundo o promotor Alexandre Graziotin, responsável pela investigação, o servidor é suspeito de exigir dinheiro para facilitar e agilizar a aprovação dos licenciamentos ambientais. James é irmão de um engenheiro dono de uma empresa de consultoria em projetos em Palhoça. O irmão está entre os empresários presos.

De acordo com o promotor, a investigação constatou que houve pagamentos em dinheiro para a aprovação de licenciamentos de três empreendimentos na cidade. Mas ele não citou a quantia e nem as obras supostamente beneficiadas. Revelou apenas que são condomínios residenciais populares.

O representante do MP não sabe precisar há quanto tempo a facilitação ocorria. Ele disse que ficou constatado durante a apuração que o servidor agia sozinho dentro da fundação e descartou envolvimento de mais funcionários.

O MP ainda não apurou se as construções são ou não em áreas de preservação permanente. Graziotin afirmou que técnicos do MP farão essa avaliação a partir de agora com os documentos e computadores apreendidos.

Não haveria indício de crime ambiental

Em princípio, segundo o promotor, não haveria crimes ambientais. Os presos foram levados para a Diretoria Estadual de Investigações Criminais (Deic), na Capital, pela manhã. À tarde, o empresário de Curitiba foi trazido do Paraná por policiais catarinenses.

A imprensa não teve acesso aos presos, que também não tiveram os nomes divulgados. Eles foram ouvidos pelo delegado Clóvis Nosse e depois recolhidos em celas da carceragem da Deic. Familiares e advogados passaram boa parte do dia no local. O inquérito deverá ser concluído e entregue à Justiça em 10 dias.
